Kid wins HK$119,000 in damages

A 5 year-old boy yesterday won $119,000 in damages from a dog owner who was found to be negligent for not controlling her dog.
The boy was knocked over by a golden retriever resulting in minor skull fracture and a perforated eardrum. The owner was playing catch with the dog in a crowded area in Discovery Bay.
HK$39k was awarded for medical costs and HK$80k for pain and suffering.
The boy is getting nightmares from the incident but I think $80 grand is a bit excessive for pain and suffering....Who do they think we are, Americans? (The parties concerned are most probably...)

Dunno, bro... I was attacked by a huge fooker of a dog when I was about 11 and it took a long time to get over the resulting fear of all dogs.

What about the long term psychological effect and fear of dogs thus the loss of pleasure of having fun with a man's best friend, leading to the deminish of the meaning of life? He should have gotten at least 5 times that amount!

ok, to put things in perspective, the defendant is an air stewardess (as oppose to say multi trillionnaires that frequent here). So the net effect of the award, with costs, would be something like 3 months' wages for her?

If this was the states the kid would get a lot more than US10K for the pain and suffering.
It is better to remain silent and be thought a fool than open ones mouth and remove all doubt.

Yes, that's exactly my point. So a person has to be declared bankrupt because of a moment's mistake? It's entirely disproportionate.

The litigation is out of hand in the US* and i'd hate to see it happen in other places in the world.
A judge suing a dry cleaner for millions for losing his pants?!! What a bag of w@nk!

Okay... flight attendant, eh? So who looks after the dog while she's off jetting around the world for days at a time? Wtf was she doing playing catch with the mutt in a crowded area? Was the dog even on a leash?
If losing the equivalent of 3 months' wages is what it takes for her to learn not to be (a) stupid or (b) selfish or (c) both, I'd say it's a small price to pay.

Well, if that's the case then you are just creating revolving credit for everyone in HK (or the world).......because everyone is either (a), (b) or (c) at some point.

reminds me of my friend's only brother. He'd just finished his graduation in the U.S., was driving along to meet some friends, drunk driver comes the other way, bam kapoot, a moment's mistake.

Sure, but there are ways you can avoid getting sucked into that cycle e.g. not playing catch with your unleashed dog in a crowded area where it is more than likely to knock a small child over and injure them. C'mon bro, it's not rocket science.

Well, for starters, I propose all mothers with crying babies be banned from air travel. Non-abiding airlines should be fined trillions of dollars.
How about annoying ringtones on public transport? 30 lashes for that at least.

gimpy, from what i read, the amount awarded was taken into consideration of the following:
- it happened on 1 May, a public holiday, very crowded day. (i'm sure being a flight attendant, she didn't need to choose that day of all days)
- the kid had blood coming out of his ear right there on the beach, it must have been quite a fracture and surely scared him a lot.
- and $80K may not have been a lot..... just a few handbags.

Then why not ban dogkeeping altogether? I think keeping dogs in Hong Kong is totally inhumane anyway.
