Twas the judge that was long winded, no? And wasnae the point that a 2.5 hour, fast paced summing in up in (most of, if not all of) the jury's non native language was not likely enable them to deliver a proper, informed verdict?

No matter, the point of a summing up is to tell the jury what they have heard, and to assist them in understanding its significance and filtering what is important.

But in theory isn't the jury supoosed to make their judgement bases on the evidence prosented to them rather than the judge's summing up. I've never really understood this summing up biz. It's as if they are saying 'forgot what you have heard over the past n days this is what I think'

That's exactly right Bloke. I guess the theory is that it makes jury less suceptible to irrelevancies in law, grandstanding by barristers, media influence etc. It does mean the judge is hugely important in ensuring legal correctness and equity of treatment for the defendant.

There was a lot of discussion at the jury selection about language capability apparently - http://www.thestandard.com.hk/stdn/std/Metro/GF08Ak02.html - plenty of potential jurors were let off or deselected because of it.

Considering it was a trial that lasted a few months (2 or 3? Can't remember), a 2.5 hour summing up is not that much. Furthermore, as rightly pointed out above, the judge has to remind the jury what can or can't be admitted as evidence (since a lot of information has been brandished throughout the trial). But I reckon these guys would still flip a coin in the jury's room.

Ah yes a rich banker husband who allegedly worked long hours drank alcohol did charlie and liked having sex. I'm not sure how much self defensive you can plead these days after rendering your victim unconscious with a drugged milkshake.

There have been cases of partial defences of systemic abuse over a number of years (Like the one where the wife snapped and set the husband on fire). But then you wind up in the loony bin, or Palais de Bintney, instead.
