No $800,000 `separation fee' for girlfriend
A judge has struck down a counterclaim by a woman against her ex-boyfriend, who stopped supporting her and did not pay a "separation fee" of HK$800,000. According to Deputy High Court Judge David Gill's written judgment, Leeky Cheng claimed Michael Chan Man-tin had verbally agreed to provide for her residence, income and share of any joint investments, regular household expenses and gifts for special occasions, as well as ongoing support for her family and son, who is not Chan's child.
Cheng alleged he also agreed to pay HK$800,000 if he separated from her. Chan paid the same "separation fee" to his previous girlfriend before Cheng in 2002, she claimed. The judgment noted that Cheng said the investments under their joint names were Chan's long-term commitment as a gift for her "loyalty and chastity to him" and "in consideration the plaintiff would cohabit with the defendant and live happily together." But their relationship ended in mid-2006.
The man claimed he and Cheng were friends engaged in a commercial relationship, and that he had brought his claim to recover the money he had "advanced."
According to Chan, he advanced HK$300,000 and HK$800,000, repayable on demand. In 2004 the pair jointly bought four properties in Sung Wong Toi Road, Sham Shing Road, Richland Gardens and Whampoa Garden. Chan said the properties were paid out of his pocket and that Cheng's interest was only as a trustee for him.
The judge said the consideration of "plain loyalty and chastity" of the woman toward the man was not good consideration, and had no reasonable cause of action.
