Of course they will - so don't tell them. Just don't pay the rent for the last 2 months - then the onus is on them to get the money out of you versus the onus being on you to get your deposit back from them.

Indeed - my previous landlady wouldn't return the deposit and we had to arrange a meeting with the small claims court - in the end they settled up before the date but it was a pain in the arse.
So this landlord isn't getting any rent for the last two months.

You used to speak the truth.

Although, having said that, my experience is that if your landlord is a largish company (so you're dealing with an employee rather than "the owner") then there's absolutely no problem doing it by the book according to the contract.

Individual owners, especially it seems from my experience and second hand reports if they are women, are a right pain.

Doesn't work that way here tho Smog.. do as we would do by is giving back the deposit to the tennant after they have moved out and you have checked the apartment is OK.. here they don't even come and check the apartment nor give the deposit back

Not true in my experience - the last apartment I rented was owned by a company (Regent Sino Ltd - if you come across one of their properties then I'd recommend them as a landlord). I paid the rent as per the contract up to the day I left (so a partial month for the last one). We fixed a time for them to inspect and me to hand the keys back. An employee came at the appointed time, looked around, checked that the aircons basically worked. Gave me a cheque for the two months deposit in return for the keys and asked me to sign a receipt for it. Dead simple. All done in 5 minutes.

It was similar in the first apartment I had here (albeit that was a company lease by my employer). It was only the second one with a right b**ch of a landlady where there were problems.

So two out of three absolutely no problem playing by the rules. For the middle one after a somewhat stressful meeting we negotiated to a settlement that was acceptable to both.

Well Smog you have had good experiences, with smaller one off owner landlords I have heard some greedy stories.. I have always just used deposit for the last months rent.. not an issue if you look after the place

I'm also moving soon. Has anyone ever had a problem where they'd put pictures and wall fixings up? I'm moving out soon and that's basically the only quibble my landlord might have, other than the fact that I've been in there 7 years and it's generally looking a bit tatty. I would hope the landlord would see that as fair wear and tear.

I remember having a fight once with the "representative" of a landlady over a 2-ring electric cooker, which she insisted they had provided and was therefore the property of the landlady, even tho we'd bought it ourselves, even tho I showed her the receipt and even tho there was no such item listed on the freaking contract in the first place. It was one of those moments where you actually can't believe you're having that conversation because it makes no sense but you have to fight it out anyway cos they're a bunch of freaking a=holes.

But don't forget the landlords still think we are all well paid expats who's companies pay for our rent so we are fair game.

Unfortunately the relative health of Asia compared to the rest of the world is only going to make matters worse.

I had this issue in my first place in HK... we had put one pic up and left the hole when we left ,, she went ballistic threatening small claims court etc.. and finally gave me some god squad s**t about sinning

I mean FFS the bint had probably made a small fortune out of us being there and paying the full asking price.. you would think she could call a contractor in to fill the hole and paint it over

Very well thankyou Paps, you must be pyschic, just completing on an overseas property this week as it would happen !

I'm still bullish about HK (but not the 30-50% Investment Banks are touting), mainly due to the low supply issue and cheap HKD borrowing, but finding the right property is increasingly difficult, Wong Chuk Hang should be good area with the MTR SIL in future years......rents will almost definitely get worse between 2008-2010, so if you wanna stay in this town and have to pay your own rent, definitely should consider buying. I've a few friends that have taken Interest Only Mortgages now in HK, if you're not paying back the capital each month as such, repayments are pretty low in comparison to renting properties of same value.

My only advise with finishing a lease, get Solicitors involved from the start - even if it costs you a few hrs of their time. If you've been given notice or giving notice, insist on name of Landlord Solicitors at least three months before moving out....give the appearance you're not a soft touch. Bring a solicitor or property agent to the final inspection (in fact could be anyone), and try find out where the Landlord lives too and his bank - in the event legal papers are served. At all times give the appearance you could be a real pain to him if he doesn't play ball. Local landlords actually hate 'ma-fan' tenants, and usually want to move on and get their place rented out again with no hassle. Don't forget, going to the Small Claims Tribunal is really quite simple, but I would emphasize you need paperwork (lots of it) and some evidence !

I've had good experiences in this town, very much as Smog details above, but totally understand the majority of situations are probably less than ideal, particularly where individuals not companies, are involved.
